General terms and conditions for booking and purchasing tourist services offered by Aqua Geoterma Resource SRL
Preamble
This contract regulates the general terms and conditions regarding the booking and purchasing of tourist services offered by SC Aqua Geoterma Resource SRL. (hereinafter referred to as “T.C.G.”), e-mail reservations@ramadaconstanta.ro (hereinafter referred to as “the Hotel”) applicable to all clients, natural or legal persons;
By making a reservation or by checking in at any of the accommodation units belonging to the hotel service provider SC Aqua Geoterma Resource SRL, the client expressly agrees to the T.C.G.
The T.G.C. clauses are drawn up in compliance with the Government Emergency Ordinance no. 34/2014 regarding consumer rights in contracts concluded with professionals.
Rates
All rates are expressed per night and include breakfast and VAT (5%).
Rates may be modified at any time, rate increases not affecting already confirmed reservations. Rate reductions may or may not affect confirmed reservations.
Making reservations
are considered reservations:
- any order sent and confirmed by the hotel, in writing from the email address reservations@ramadaconstanta.ro;
- any order sent through the online booking platform within the website www.ramadaconstanta.ro;
IMPORTANT:
We accept Sodexo, Edenred, Up Romania holiday vouchers, provided that the holder of the holiday vouchers is accommodated at the Ramada by Wyndham Constanta hotel.
If the reservation is canceled, the stay paid for with holiday vouchers can be rescheduled, according to the law, the reimbursement of the voucher value in cash being not possible.
Guarantee and payment of reservations
Reservations are considered guaranteed at the time of payment confirmation.
Payment for reserved tourist services can be made by bank transfer, holiday vouchers (paper or electronic format) or by card, based on the proforma invoice issued by the hotel.
a. in the case of reservations made by phone or e-mail:
- the reservation is guaranteed by the client by paying an advance of 50% of the total value of the ordered services, within a maximum of 5 days from the date of booking, and the difference of 50% will be paid at the reception, at the time of accommodation.
- the reservation is guaranteed by the Hotel after receiving the advance payment.
- if the advance payment is not made, the reservation will be automatically canceled.
b. in the case of reservations with promotional rates or Early Registrations made by phone or e-mail:
- the reservation is guaranteed by the client by paying in full for the ordered stay until the end of the discount threshold, otherwise, the reservation will be automatically canceled; Any Early Bird rate reservation is valid for a minimum stay of 5 nights.
c. In the case of standard rate reservations made through the online booking platform on the hotel’s website:
- The customer can guarantee the reservation by credit card, after automatic verification of the card details entered in the reservation form, withholding the amount according to the displayed policy and receiving the automatically issued reservation confirmation from the Hotel (in real time);
- The customer can also guarantee the reservation by bank transfer of the first night of accommodation to the Hotel’s bank account, within a maximum of 3 days from the date of reservation confirmation, otherwise, the reservation will be automatically canceled.
- The remaining payment for the stay is paid upon arrival, in cash or by bank card (debit/credit Visa / Mastercard).
Request for change of billing dates
The customer is obliged to check the details on the invoice before paying for the services. The payment by the client has the value of an express confirmation of the tax invoice, and any subsequent requests for modification will not be taken into account by the Hotel.
Children’s conditions:
- 1 or 2 children aged 0 to 2.99 years old benefit from free accommodation in the same bed with their parents (without extra bed / baby cot offered free of charge, subject to availability), and free meals.
- 1 or 2 children aged 3 to 6.99 years old benefit from free accommodation in the same bed with their parents (without extra bed) and will pay 50% of the value of the meals (respectively 25 lei breakfast)
- 1 or 2 children aged 7 to 15.99 years old benefit from free accommodation in the same bed with their parents (without extra bed) and will pay 100% of the value of the meals (respectively 50 lei breakfast)
- Starting at the age of 16 years, accommodation/meals will be provided as adults;
- Upon request, an extra bed can be provided for a fee at the rate of 75 lei/day/ in double/twin rooms
- A maximum of one extra bed and one baby cot can be added to each accommodation structure within the hotel.
Adult conditions:
- In the case of the third adult staying in a room / apartment with 2 adults, he/she is obliged to pay the additional accommodation cost of 125 lei/night (breakfast included).
- In the case of the fifth adult staying in the two-bedroom apartment with 4 adults, he/she is obliged to pay the additional accommodation cost of
Maximum accommodation capacity per room type
- Double room – 2 adults + 2 children aged between 0-15.99 years;
- Junior suite – 2 adults + 2 children aged between 0-15.99 years or 3 adults;
- Suite room 1 bedroom – 2 adults + 2 children between 0-15.99 years or 3 adults +2 children between 0-15.99 years;
- Suite room 2 bedrooms – 4 adults + 2 children between 0-15.99 years or 5 adults + 1 child between 0 – 15.99 years.
Cancellations / No show / Penalties
If the reservation for the period 01.07 – 31.08.2021 is canceled:
– up to 10 (ten) days before the date of arrival, no penalty will be charged.
– less than 10 (ten) days before arrival or in case of no-show, the first night’s accommodation rate, including breakfast, will be charged.
If the reservation for the period 01.04. – 30.06.2021; 01.09. – 30.09.2021 is canceled:
– up to 5 (five) days before the date of arrival, no penalty will be charged.
– less than 5 (five) days before arrival, the first night’s accommodation rate, including breakfast, will be charged
If the reservation for the period 01.01. – 31.03.2021; 01.10. – 31.12.2021 is cancelled:
– at least 2 (two) days before the arrival date, no penalty will be charged.
– less than 2 (two) days before the arrival date, or in case of no-show, the rate for the first night of accommodation, with breakfast included, will be charged.
Cancellation or in case of no-show of reservations made for special offers (including early registrations) is penalized with 100% of the reservation value.
No show (or non-honored reservation) represents a confirmed and non-cancelled reservation as a result of which the client did not arrive at the hotel on the established date. In case of no-show of the client at the hotel, the amount paid in advance is retained in full.
In the case of stay discounts announced by customers during the stay, the Hotel reserves the right to retain the value of unconsumed services as damages, based on the punctual evaluation of each situation.
Check in / Check out
Official check-in time is 3:00 PM
Check out time is 12:00 PM
Late Check out will be offered depending on availability, upon customer request, and at an additional cost representing 50% of the value of one night’s accommodation (the rate displayed at the reception), without breakfast.
Luggage can be stored in the luggage room for a maximum of 24 hours, without payment.
Accommodation is based on an identity document (identity card, passport, birth certificate in the case of children) and a copy of the reservation confirmation or the advance invoice issued by the Hotel.
Room allocation is based on the availability of the hotel on the day of accommodation.
Parking is free within the limit of available spaces (120 spaces).
Blanche Restaurant / Centrum Bar / Atmosphere sky Bar
The opening hours of the Blanche Ramada Restaurant, in a la carte mode, are 12:00 – 23:00.
The buffet breakfast (for a minimum of 25 people) is served daily between 7:30-10:30, in the Blanche Ramada Restaurant.
Access to the restaurant is only allowed with a decent outfit, without beach objects and accessories.
The opening hours of the Atmosphere sky Bar on the 8th floor are 12:00 – 24:00.
It is strictly forbidden to take food or drinks from the restaurant into the hotel.
It is strictly forbidden to bring food and drinks from outside into the hotel or restaurant.
Smoking:
Smoking is prohibited inside the hotel, except on the balconies of the rooms and the hotel’s outdoor spaces equipped with ashtrays.
The hotel reserves the right to evict guests who do not comply with this obligation and to cancel their reservation.
Special needs:
Most of the hotel spaces are accessible to people with disabilities. Any special needs must be announced in advance.
Pets
Pets are not allowed in the hotel. The hotel has the right to refuse accommodation to customers accompanied by pets under penalty of canceling the reservation and paying a penalty equivalent to the entire value of the services related to the first night of accommodation.
Personal data protection:
The Ramada Constanta Hotel guarantees the confidentiality of the personal data of all customers. Personal data collected when making a reservation or for the provision of tourism and public catering services will not be disclosed to third parties except in cases where the Hotel must comply with the obligations imposed by the legislation in force.
According to the requirements of Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, the company Aqua Geoterma Resource SRL collects and processes the personal data of its clients only for the purpose of providing tourism and public catering services.
The recorded information is intended for use by the operator and is communicated only to the following recipients: the data subject, the legal representatives of the data subject, the power of attorney of the operator and other companies in the same group as the operator.
The client has the right of access to data, the right of intervention and the right of opposition to personal data, these rights being exercised in accordance with the provisions of art. 13, 14, 15 of Law no. 677/2001. Thus, any person may exercise the rights listed above by sending a request to the company Aqua Geoterma Resource SRL, at its headquarters in, Constanța County, Bolwing Area, Vacanta village, Mamamia, drawn up in writing, dated and signed, a request that will mention the identification data of the person in question, including the correspondence address, as well as the data on which the intervention is requested, the justified reason and the method of intervention. Also, the person whose data are processed has the right to request, without any justification, free of charge, in writing, by registered letter with acknowledgement of receipt, dated and signed, that personal data not be processed by the company Aqua Geoterma Resource SRL. for the purpose of providing tourism and public catering services. the company Aqua Geoterma Resource SRL., within 15 days from receiving the request according to the above, will communicate in writing the requested information and, where appropriate, the measures taken.
Environmental Protection:
To signal the change of linen or towels, guests are asked to leave them on the floor, in the bathroom.
Security:
- The hotel and public spaces are monitored by video system.
- Clients are obliged to request the Hotel to keep valuables (documents, money, electronic devices or other such valuables). These will be handed over to the reception based on a report.
- The hotel does not assume responsibility for forgotten, lost or allegedly stolen objects within the hotel, conference rooms, restaurant, bar and parking.
- The hotel does not assume responsibility for any accidents or injuries that may occur as a result of the inappropriate use of hotel or restaurant facilities.
Hotel Obligations
The hotel is obliged to provide customers with the reserved accommodation space together with additional services at the quality level required by the Classification Methodological Norms.
if, after the start of the stay, a significant part of the ordered tourist services is not performed, the Hotel has the following obligations:
a) to offer the client appropriate alternatives in order to continue the stay, without increasing the price, respectively the tourist services offered must be of the same quality and quantity;
b) to refund to the client the amounts representing the difference between the tourist services paid and those actually provided during the tourist trip, together with potential penalties incurred due to the termination of the stay;
c) in the event that appropriate alternatives cannot be offered to the client or the client does not accept them for good reasons, to ensure the return of the value of the services not provided.
The Hotel is liable for the proper execution of its obligations towards the clients, except in the following cases:
a) when the non-fulfillment or defective fulfillment of the obligations assumed through the T.C.G. is due to the client;
b) when the failure to fulfill obligations is due to a fortuitous event or force majeure, as these cases are defined by the Civil Code (for example but not limited to: changes in schedule or itinerary, delays in transport traffic, etc.).
Client’s obligations
- The Client is obliged to notify the Hotel by phone (0785 726 232) or e-mail (frontdesk@ramadaconstanta.ro) if he/she arrives after midnight on the day of accommodation, under penalty of cancellation of the reservation and retention of the amounts paid as an advance as damages.
- The Client is obliged to check the inventory list of the room upon arrival, which he/she will have to hand over in the same conditions upon departure, otherwise any shortages or deterioration of the goods in the room, will be borne by the guest. If upon arrival in the room the inventory list is different from the inventory items present in the room, the Customer is obliged to inform the reception at number 100/150 regarding this aspect.
- The Customer is liable to the Hotel for damages caused, through negligence or with intent, to other customers or the staff, buildings, furniture and equipment of the hotel.
- It is strictly forbidden to bring and use household appliances in the Hotel rooms (juicer, kettle, etc.).
- It is forbidden to use the towels from the room on the beach.
- The Customer is responsible for taking note of and complying with the T.C.G. for the entire duration of the stay.
Visitors:
- Clients may receive visitors in the hotel rooms between 08:00 and 22:00, at no additional cost.
- If clients receive visitors between 22:00 and 08:00, the latter will have to pay the difference in rate and register at the reception.
Conduct
- The hotel reserves the right to refuse accommodation or service in the restaurant to intoxicated, rude or turbulent clients who, through their attitude, harm the hotel’s image or disturb other clients.
- The hotel reserves the right to select its customers.
Complaints
- Complaints regarding the quality of the tourist services provided will be made on the spot, throughout the tourists’ stay in the Hotel. Complaints subsequent to the end of the stay will not be taken into account by the Hotel.
- Complaints regarding the damage caused by the theft, destruction or damage of goods brought by the customer to the hotel must be brought to the attention of the hotel no later than 24 hours from the date on which it was discovered.
Applicable law. Disputes
- The rights and obligations of the parties provided for by the T.C.G., as well as all legal effects produced by the T.C.G. will be interpreted and governed in accordance with Romanian law in force.
- All disputes arising from or in connection with the provision of services that form the subject matter of the T.C.G. will be resolved by the competent Romanian courts at the headquarters of Aqua Geoterma Resource SRL.
Final provisions
- The hotel has the right to unilaterally modify the T.C.G. at any time.
- Modification of the T.C.G. will be binding on customers from the date on which it was brought to their attention by any means (display, e-mail, etc.).
- The modification of the T.C.G. will not affect the rates for already confirmed reservations.
