General terms and conditions for booking and purchasing tourist services offered by Aqua Geoterma Resource SRL

Preamble

This contract regulates the general terms and conditions regarding the reservation and purchase of tourist services offered by SC Aqua Geoterma Resource SRL. (hereinafter referred to as “T.C.G.”), e-mail reservations@ramadaconstanta.ro (hereinafter referred to as “the Hotel”) applicable to all natural or legal customers;

By making a reservation or by staying (check-in) at any of the accommodation units belonging to the hotel service provider SC Aqua Geoterma Resource SRL, the client expressly agrees to the T.C.G.

The clauses of T.G.C. are drawn up in compliance with GEO no. 34/2014 on consumer rights in contracts concluded with professionals.

Rates

All rates are per night and include breakfast and VAT (5%).
Rates are subject to change at any time, as fare increases do not affect bookings already confirmed. Rate reductions may or may not affect confirmed bookings.

Making reservations

A Reservation is considered active if:

- any order sent and confirmed by the hotel, in writing from the email address reservations@ramadaconstanta.ro;
- any order sent through the online booking platform within the site www.ramadaconstanta.ro;

IMPORTANT:
We accept Sodexo, Edenred, Up Romania holiday tickets, provided that the holiday ticket holder is accommodated in the Ramada by Wyndham Constanta hotel.

If the reservation is canceled, the stay paid with holiday tickets can be rescheduled, according to the law, the refund of the value of the tickets in cash is not possible.

Guarantee and payment of reservations

Reservations are considered guaranteed at the time of payment confirmation.

Payment for booked tourist services can be made by bank transfer, holiday vouchers (paper or electronic) or by card, based on the proforma invoice issued by the hotel.

a. In case of reservations made by phone or e-mail:
- the reservation is guaranteed by the client by paying an advance of 50% of the total value of the ordered services, within 5 days from the date of booking, and the difference of 50% will be paid at the reception, at the time of accommodation.

- the guarantee of the reservation from the Hotel will be made after receiving the advance payment.

- in case the advance payment is not made, the reservation will be canceled automatically.

b. In case of reservations with promotional rates or Early registrations made by phone or e-mail:
- the reservation is guaranteed by the client by paying in full the stay ordered until the end of the discount threshold, otherwise, the reservation will be canceled automatically; Any reservation with Early Registration fee is valid for a minimum stay of 5 nights.

c. In case of reservations with standard rates made through the online booking platform on the hotel website:
- the guarantee of the reservation by the client can be made by credit card, after the automatic verification of the card data entered in the reservation form, with the retention of the amount according to the displayed policy and the receipt from the Hotel of the reservation confirmation issued automatically (in real time);

- the reservation guarantee by the client can be made by paying by bank transfer the first night of accommodation in the bank account of the Hotel, within 3 days from the date of confirmation of the reservation, otherwise, the reservation will be canceled automatically.

The rest of the payment for the stay is paid on arrival, cash or bank card (debit / credit Visa / Mastercard).

Request to change billing data

The customer has the obligation to check the details of the invoice before paying the value of the services. The payment by the customer has the value of an express confirmation of the tax invoice, and any subsequent requests for change will not be considered by the Hotel.

Children's conditions:

1 or 2 children aged between 0 and 2.99 years benefit from free accommodation in the same bed with parents (no extra bed / baby cot offered free of charge subject to availability), and free meals.

1 or 2 children aged between 3 and 6.99 years benefit from free accommodation in the same bed with parents (no extra bed) and will pay 50% of the value of meals (respectively 25 lei breakfast)

1 or 2 children aged between 7 and 15.99 years old benefit from free accommodation in the same bed with their parents (without extra bed) and will pay 100% of the value of the meals (respectively 50 lei breakfast)

Starting with the age of 16, the accommodation / meals will be performed in adult conditions;

On request, extra bed can be offered for a fee of 75 lei / day / in double / twin rooms

A maximum of one extra bed and a baby cot can be added to each accommodation structure within the hotel.

Adult conditions:

In the case of the third adult accommodated in a room / apartment with 2 adults, he has the obligation to pay the additional accommodation cost of 125 lei / night (breakfast included).

In the case of the fifth adult accommodated in the two-bedroom apartment with 4 adults, he has the obligation to pay the additional accommodation cost of 125 lei / night (breakfast included).

Maximum accommodation capacity per room type

Double room - 2 adults + 2 children aged 0-15.99 years;
Junior suite - 2 adults + 2 children aged 0-15.99 years or 3 adults;
Suite room 1 bedroom - 2 adults + 2 children between 0-15.99 years or 3 adults +2 children between 0- 15.99 years;
Suite room 2 bedrooms - 4 adults + 2 children between 0-15.99 years or 5 adults + 1 child between 0 - 15.99 years.

Cancellations / No show / Penalties

If the reservation for the period 01.07 - 31.08.2021 is canceled:
- up to 10 (ten) days before the arrival date, no penalty will be charged.
- less than 10 (ten) days before arrival or in case of no-show, the rate for the first night of accommodation will be charged, with breakfast included.

If booking for the period 01.04. - 30.06.2021; 01.09. - 30.09.2021 is canceled:
- up to 5 (five) days before the arrival date, no penalty will be charged.
- less than 5 (five) days before arrival, the rate for the first night of accommodation will be charged, with breakfast included

If the reservation for the period 01.01 - 31.03.2021; 01.10. - 31.12.2021 is canceled:
- at least 2 (two) days before the arrival date, no penalty will be charged.
- less than 2 (two) days before the arrival date, or in case of no-show, the rate for the first night of accommodation will be charged, with breakfast included.

Cancellation or non-presentation of reservations made for special offers (including early registrations) is penalized with 100% of the value of the reservation.

No show (or unreserved reservation) is the confirmed and canceled cancellation after which the client did not arrive at the hotel on the set date. In case the client does not show up at the hotel, the amount paid in advance is fully withheld.

In case of stay reductions announced by customers during the stay, the Hotel reserves the right to withhold as damages the value of non-consumed services, based on the timely assessment of each situation.

Check in / Check out

The official check-in time is 15:00
Check out time is 12:00

Late Check out will be offered subject to availability, at the request of customers, and at an additional cost representing 50% of the value of one night's accommodation (the rate displayed at the reception), without breakfast.

Luggage can be stored in the luggage room for up to 24 hours free of charge.
Accommodation is based on the identity card (identity card, passport, birth certificate for children) and a copy of the booking confirmation or advance invoice issued by the Hotel.
Room allocation is subject to hotel availability on the day of accommodation.
Parking is free within the available spaces (120 places).

Restaurant Blanche / Centrum Bar / Atmosphere Sky Bar

The opening hours of the Blanche Ramada Restaurant, a la carte, are 12:00 - 23.00.
Buffet breakfast (for a minimum of 25 people) is served daily from 7.30 to 10.30 in the Blanche Ramada Restaurant.

Inside the restaurant, access is allowed only with a decent outfit, without beach objects and accessories.

The Atmosphere Sky Bar on the 8th floor is 12.00 - 24.00.
It is strictly forbidden to extract / introduce food or drinks from the restaurant inside the hotel.

It is strictly forbidden to enter the hotel or restaurant with food and drinks from outside.

Smoking:

Smoking is not allowed inside the hotel, except for the balconies of the rooms and the outdoor areas of the hotel arranged / equipped with ashtrays.

The hotel reserves the right to evict guests who do not comply with this obligation and to cancel their reservation.

Special needs:

Most of the spaces in the hotel are accessible to people with disabilities. Any special needs must be announced in advance.

Pets

Pets are not allowed inside the hotel. The hotel has the right to refuse the accommodation of guests accompanied by pets under the sanction of cancellation of the reservation and payment of a penalty equivalent to the full value of the services related to the first night of accommodation.

Protection of personal data:

Hotel Ramada Constanta guarantees the confidentiality of the personal data of all customers. Personal data collected when making a reservation or for the provision of tourism and public catering services will not be disclosed to third parties unless the Hotel must comply with the obligations imposed by applicable law.

According to the requirements of Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data, the company Aqua Geoterma Resource SRL collects and processes the personal data of its customers only for the purpose of providing tourism and public catering services.

The registered information is intended for use by the operator and is communicated only to the following recipients: the data subject, the legal representatives of the data subject, the operator's proxies and other companies in the same group as the operator.

The customer has the right of access to data, the right to intervene and the right to oppose personal data, these rights may be exercised in accordance with the provisions of art. 13, 14, 15 of Law no. 677/2001. Thus, any person can exercise the rights listed above by sending a request to the company Aqua Geoterma Resource SRL, at its headquarters in, Jud. ConstanĊ£a, Zona Bolwing, Sat Vacanta, Mamamia drawn up in written, dated and signed form, requesting the identification of the person concerned, including the correspondence address, as well as the data on which the intervention is requested, the justified reason and the manner intervention. Also, the person whose data are processed has the right to request, without any justification, free of charge, in writing, by registered letter with acknowledgment of receipt, dated and signed, that personal data not be processed by the company. Aqua Geoterma Resource SRL. in order to provide tourism and catering services. The company Aqua Geoterma Resource SRL., Within 15 days from the receipt of the request according to those mentioned above, will communicate in writing the requested information and, as the case may be, the measures taken.

Environment protection:

Guests are asked to leave their walk-in towels in the bathroom to signal a change of linen or towels.
Safety:

The hotel and public spaces are video-surveilled.
Customers have the obligation to ask the Hotel to keep valuables (documents, money, electronic equipment or other such valuables). They will be handed over at the reception based on a report.
The hotel does not take responsibility for forgotten, lost or allegedly stolen items inside the hotel, conference rooms, restaurant, bar and car park.
The hotel does not assume responsibility for any accidents or injuries that may occur due to improper use of the facilities in the hotel or restaurant.

Hotel obligations

The hotel has the obligation to provide customers with the reserved accommodation space together with the additional services at the quality level imposed by the Methodological Classification Norms.

If, after the start of the stay, a significant part of the ordered tourist services is not performed, the Hotel has the following obligations:

a) to offer the client appropriate alternatives in order to continue the stay, without increasing the price, respectively the tourist services offered to be of the same quality and quantity;
b) to reimburse to the client the amounts representing the difference between the paid tourist services and those actually provided during the tourist trip, together with the potential penalties incurred due to the termination of the stay;
c) in case the client cannot be offered suitable alternatives or he does not accept them for good reasons, to ensure the return of the value of the services not provided.
The hotel is responsible for the proper execution of obligations to customers, except in the following cases:
a) when the non-fulfillment or defective fulfillment of the obligations assumed by T.C.G. is due to the customer;
b) when the non-fulfillment of obligations is due to a fortuitous or force majeure case, as these cases are defined by the Civil Code (for example but not limited to: changes in schedule or itinerary, delays in means of transport, etc.) .

Customer obligations

The client has the obligation to notify the Hotel by phone (0785 726 232) or e-mail (frontdesk@ramadaconstanta.ro) if the day of accommodation arrives after 24.00, under the sanction of cancellation of the reservation and retention as damages of the amounts paid as an advance.

The client has the obligation to check on arrival the inventory list of the room that will have to be handed over in the same conditions upon departure, otherwise any deficiencies or degradation of the goods in the room will be borne by him. If on arrival in the room the inventory list is different from the inventory items present in the room, the Client has the obligation to inform the reception at number 100/150 regarding this aspect.

The customer is liable to the Hotel for damages caused, through fault or intent, to other customers or staff, buildings, furniture and equipment of the hotel.

It is strictly forbidden to introduce and use in the rooms of the Hotel household appliances (juicer, kettle, etc.).

It is forbidden to use towels in the room on the beach.

The client is responsible for acknowledging and complying with the T.C.G. throughout the stay.

The visitors:

Guests can receive visitors in the hotel rooms between 08:00 and 22:00 at no extra cost.
If guests receive visitors between 22:00 and 08:00, they will have to pay the difference and check in at the reception.

The conduct

The hotel reserves the right to refuse accommodation or serving in the restaurant to drunk, rude or turbulent customers who, through their attitude, damage the image of the hotel or disturb other customers.

The hotel reserves the right to select its customers.

Complaints

Complaints regarding the quality of the tourist services provided will be made on the spot, during the entire stay of the tourists in the Hotel. Complaints after the end of the stay will not be considered by the Hotel.

Claims for damage caused by theft, destruction or damage to property brought by the customer to the hotel must be notified to the hotel no later than 24 hours from the date on which it was found.

Applicable law. Litigation

The rights and obligations of the parties under the T.C.G., as well as all legal effects that the T.C.G. will be interpreted and governed in accordance with the Romanian legislation in force. All disputes arising out of or in connection with the provision of services forming the subject of the T.C.G. will be settled by the competent Romanian courts at the headquarters of Aqua Geoterma Resource SRL.

Final provisions

The Hotel reserves the right to unilaterally change the T.C.G. Modification of T.C.G. will be enforceable against customers from the date on which it was notified to them by any means (display, e-mail, etc.). Modification of T.C.G. will not affect the rates in case of already confirmed reservations.
