General terms and conditions of booking and purchase of the tourist services provided by Aqua Geoterma Resource SRL

Preamble
This agreement governs the general terms and conditions for reservation and purchase of tourism services offered by Aqua Geoterma Resource SRL. (hereinafter referred to as "GTC"), reservations@ramadaconstanta.ro (hereinafter referred to as the "Hotel") applicable to all natural or legal customers;
By making a reservation or by check-in to any of the accommodation units belonging to the hotel services provider Aqua Geoterma Resource SRL, the customer expressly accepts his / her consent to our GTC.
Clauses in the GTC are drafted in compliance with GEO no. 34/2014 on consumer rights in contracts concluded with professionals.

Rates
The minimum occupancy for the double room is 2 adults + 2 children between 0 and 15,99;
All rates are per night and include breakfast and VAT (9%).
Rates can be changed at any time, with tariff increases not affecting reservations already confirmed. Discounts may or may not affect confirmed reservations.

Booking process
Actions that are considered as reservation:
- any order sent by any means to the Hotel provided the Hotel confirmed this order on email address: reservations@ramadaconstanta.ro;
- any order submitted via the online booking platform within the www.ramadaconstanta.ro site;

Guarantee and payment of reservations
Reservations are considered secured at the time of payment confirmation.
Payment of reserved tourist services can be made by credit card or by payment of the proforma invoice issued by the Hotel.

a. For standard tarrif bookings made by telephone or e-mail:
- Reservation is made by the client by paying an advance equal to the value of the services for the first night of accommodation, within 3 days from the date of confirmation of the reservation, otherwise, the reservation will be canceled automatically.
- Booking of the hotel will be made after receipt by e-mail (reservations@ramadaconstanta.ro), of th proof of payment of the advance, sent by the client; the invoice issued by the hotel after the confirmation of the payment guarantees the reservation.

b. In the case of reservations with promotional rates or early registrations made by telephone or e-mail:
- The guarantee of the reservation is made by the client and it is necessary to pay the entire stay ordered until the date of the promotion otherwise the reservation will be canceled automatically.
- Any reservation with Early Booking rates is valid for a minimum stay of 5 nights
- Hotel guarantee of the booking will be made after receipt by e-mail (reservations@ramadaconstanta.ro) of a proof of payment of the advance sent by the client; the invoice issued by the hotel after the confirmation of the payment guarantees the reservation.

c. For standard bookings made through the online booking platform on the hotel site:
- Booking by the customer can be guaranteed by credit card after automatic verification of the card data entered in the booking form, retaining the equivalent amount of the first night of accommodation and the Hotel's receiving of the booking confirmation issued in real time.
- The guarantee of the reservation by the client can be made by paying the first night of accommodation in the hotel's bank account within 3 days from the date of confirmation of the reservation, otherwise, the reservation will be canceled automatically.

The remaining payment for the stay is paid at the time of arrival, cash or by bank card (debit / credit).
The customer has the obligation to verify the details of the invoice before paying the services value. The payment made by the customer has the value of an express confirmation of the invoice, and any subsequent modification requests will not be considered by the Hotel.

Supplements for children and additional adults:

Children Conditions:
1/2 children between 0 - 2.99 years in the room with 2 adults: 100% free of charge at the accommodation and at the meals (free baby cot free of charge, no extra bed);
1/2 children between 3 - 6.99 years old in the room with 2 adults: 100% free accommodation (without extra bed) and 50% of the breakfast fee 23 lei / day / pax and 50% off the ordered meals;
1/2 children between 7 -15.99 years old in the room with 2 adults: 100% free accommodation (without extra bed) and pay 100% of the breakfast fee 46 lei / day / pax and pay 100% of the price of the ordered meals;
from the age of 16 years accommodation / meals will be made in adult conditions;

Upon request, extra bed can be paid at the rate of 70 lei / day. In each accommodation structure of the hotel card can be added maximum an extra bed and a baby cot.

Adult conditions:
In the case of the third adult accommodated in a room / apartment with 2 adults, it is obligatory during 14.07 - 20.08.2017, to pay the additional cost of accommodation in the amount of 140 lei / night and the additional cost for the meals and during 01.04 - 31.05; 01.06 - 04.07.2018; 09.07 - 13.07.2018; 21.08 - 30.09, to pay the additional cost of accommodation in the amount of 89 lei / night and the additional cost of the meals;
For the fifth adult accommodated in the two-bedroom apartment with 4 adults, it is mandatory for the interval 14.07 - 20.08.2017 to pay the extra cost of accommodation of 140 lei / night and the additional cost for the meals and during the periods 01.04 - 31.05; 01.06 - 04.07.2018; 09.07 -  13.07.2018; 21.08 - 30.09, to pay the additional cost of accommodation in the amount of 89 lei / night and the additional cost of the meals;

Cancellations / non-presentations / penalties
Booking for the interval 14.07 - 20.08.2018 is canceled:
- Up to 10 (ten) days before the arrival date, no penalty will be charged.
- Less than 10 (ten) days prior to arrival or in case of no-show, the first night rate with breakfast included will be charged.

Booking for the interval 01.04 - 31.05.2018; 01.06 - 13.07; 21.08 - 30.09.2018, is canceled:
- Up to 5 (five) days before the arrival date, no penalty will be charged, except for the NEVERSEA 05.07 - 08.07.2018 Music Festival, including any cancellation or any other changes made with at least 9 (new) days of commencement of your stay.
- Less than 5 (five) days before arrival, the first night's charge will be charged with breakfast, except for the NEVERSEA 05.07 - 09.07.2018 Music Festival, when cancellations or any other changes will be made to at least 9 (nine) days from the start of the stay and will be charged the two-night rate with breakfast included.

For the period 01.10. - 31.12.2017, cancellations or any other changes will make:
- At least 2 (two) days before the start of the stay, no penalty will be charged.
- Less than 2 (two) days before the start of your stay, you will be charged the first night with breakfast included.

Cancellation or in case of non-submission on special offers reservations (including early registrations) is subject to 100% of the reservation.
Early Booking discount DO NOT apply to bookings during the NEVERSEA Music Festival, except for bookings that have a minimum stay of 5 nights with differentiated rates.

Non-present (or disregarded reservation) is the confirmed and unannounced reservation as a result of which the customer did not arrive at the hotel on the date set. In the event that the customer does not present to the hotel, the amount paid in advance shall be forfeited in full.
In the case of discounts announced by customers during their stay, the hotel reserves the right to retain the value of the services not consumed as a result of the point-to-point evaluation of each situation.

Arrival and Departure
Accommodation is from 16.00 a.m. and the release of the rooms is made no later than 12:00 p.m.
At the request of the clients and when the hotel has spaces, it is possible to exceed the time of release of the late check-out room (maximum 5 hours over 12:00h) and will be paid at the reception for the half-day accommodation without breakfast, at the reception tariff displayed;
Luggage may be kept in the luggage compartment for up to 24 hours, free of charge.
Accommodation is based on identity card (identity card, passport, birth certificate for children) and copy of reservation confirmation or advance payment issued by the hotel.
The rooms are allocated according to the availability of the hotel on the day of accommodation. For this reason, it is not possible to guarantee a room on a certain floor, adjoining rooms or located in a particular sector. Such requests are considered to be preferences of tourists that the Hotel seeks to meet within the availability limits.
Parking is free of charge within the available places (120 places).

Restaurant and Bar Running Program:
Ramada's a la carte restaurant is open from 12:00 to 24:00.
Buffet breakfast (for a minimum of 25 people) is served daily from 7.30-10.00 in the Ramada Restaurant.
Half board (lunch or dinner, 70 lei / person / day) or full board (lunch and dinner, 130 lei / person / day) will be buffet style (minimum 25 persons) - or a la carte in the Ramada Restaurant between 13:00 and 15:30 for breakfast and between 19:00 and 21:00 for dinner.
In the restaurant, access is allowed only with a decent outfit, with no items and beach accessories.

The 8th-floor Atmosphere Bar's program is 12.00-24.00.
It is strictly forbidden to remove food or beverage from the restaurant.
It is strictly forbidden access to the hotel or restaurant with food and beverages from the outside.

Smoking:
Smoking is forbidden in the hotel, except for the hotel's balconies and the exterior spaces of the hotel furnished with ashtrays.
The hotel reserves the right to evict customers who fail to comply with this obligation and to cancel their reservation.

Special needs:
Most of the hotel's rooms are accessible to people with disabilities. Any special need must be announced in advance.

Pets
Pets are not allowed in the hotel. The hotel has the right to refuse to accommodate guests accompanied by pets subject to the cancellation of the reservation and the payment of a penalty equivalent to the full value of the services related to the first night of accommodation.

Personal Data Protection:
Hotel Ramada Constanta guarantees the privacy of all the customers' personal data. Personal data collected when making a reservation or providing travel and catering services will not be disclosed to third parties unless the hotel has to comply with the obligations imposed by applicable law.
According to the requirements of Law no. 677/2001 for the protection of individuals with regard to the processing of personal data and the free movement of such data Aqua Geoterma Resource SRL collects and processes the personal data of its clients only for the purpose of providing tourism and public catering services.
The recorded information is intended for use by the operator and is only communicated to the following recipients: the person concerned, the legal representatives of the person concerned, the authorized representative of the operator and other companies in the same group with the operator.
The Customer has the right of access to data, the right to intervene and the right to object to personal data, these rights may be exercised in accordance with the provisions of Articles 13, 14, 15 of Law no. 677/2001. Thus, any person may exercise the rights listed above by submitting a request to Aqua Geoterma Resource SRL, at its headquarters in, Jud. Constanta, Bolwing Zone, Sat Vacanta, Mamaia, written, dated and signed, requesting the identification details of the person concerned, including the address of the correspondent, as well as the data on which the intervention is requested, the reason for and the way of intervention. Also, the person whose data is processed has the right to request, without any justification, in writing, by registered letter with acknowledgment of receipt, dated and signed, that the personal data are not processed by the company Aqua Geoterma Resource SRL for the purpose of providing tourism and public catering services. Aqua Geoterma Resource SRL, within 15 days of receipt of the request as mentioned above, shall communicate in writing the information requested and, where appropriate, the measures taken.

Environment protection:
To signal change of linen or towels, guests are kindly requested to leave them on the bathroom floor.

Safety:
The hotel and public areas are supervised by a video system.
Customers are required to request the hotel to keep valuables (documents, money, electronic equipment or other such valuable items). These will be handed over at the reception desk based on a minutes.
The hotel does not take responsibility for forgotten, lost or alleged stolen items in the hotel, conference rooms, restaurant, bar and parking.
The hotel does not take responsibility for any accidents or injuries that may result from inappropriate use of the hotel or restaurant facilities.

Obligations of the Hotel
The hotel has the obligation to provide the guest accommodation with the additional services at the quality level required by the Methodological Norms of Classification.
If, after the start of the stay, an important part of the ordered tourist services is not performed, the hotel has the following obligations:
a) provide the client with adequate alternatives to continue the stay, without increasing the price, respectively the offered tourist services of the same quality and quantity;
b) refund to the client the sums representing the difference between the paid tourist services and the actual services rendered during the tourist trip, together with the potential penalties due to the termination of the stay;
c) if the appropriate alternative client can not be offered to the customer or he does not accept them for justified reasons, to ensure the return of the non-repaid services.


The hotel is responsible for the good execution of the obligations towards the clients, except for the following cases:
a) when the failure or defective fulfillment of the obligations assumed by GTC (General Terms and Conditions) is due to the customer;
b) when the non-fulfillment of the obligations is due to a fortuitous or force majeure, as these are defined by the Civil Code (for example but not limited to: changes in timetable or itinerary, delays in the traffic of the means of transport, etc.).

Customer's obligations
The client has the obligation to announce the hotel by phone (0785 726 232) or e-mail (reservations@ramadaconstanta.ro) if on the day of arrival arrives after 24:00 h, subject to the cancellation of the booking and the retention of the amounts paid as an advance as damages.
The customer has the obligation to check on arrival the inventory of the room that he / she will have to leave under the same conditions on departure, otherwise any deficiencies or degradations of the goods in the room will be borne by him / her. In case the inventory list is different from the inventory objects present in the room when arriving in the room, the Customer has the obligation to call the reception number 100 regarding this aspect.
Customer is liable to the Hotel for damages caused, whether intentionally or intentionally, to other clients or staff, buildings, furniture and equipment of the hotel.
It is strictly forbidden to introduce and use household appliances (fruit juicer, kettle, etc.) in the hotel's rooms.
It is forbidden to use hotel towels on the beach.
Customer is responsible for knowing and observing GTC throughout the stay.

Visitors:
Customers can receive guests in the hotel rooms between 08:00 and 22:00, at no additional cost.
If customers receive visitors between 22: 00-08: 00, the latter will have to pay the fare difference and register at the reception.

Conduct
The hotel reserves the right to refuse accommodation or serving in the restaurant of intoxicated, rude or turbulent customers who, by their attitude, damage the image of the hotel or disturb other customers.
The hotel reserves the right to select its clients.

Complaints
Complaints regarding the quality of the provided services will be made on the spot, during the stay of the tourists in the Hotel. Complaints after the end of the stay will not be considered by the Hotel.
Complaints about damage caused by the theft, destruction or damage of goods brought by the client to the hotel must be brought to the attention of the hotel no later than 24 hours from the date it was found.

Applicable law. Litigation
The rights and obligations of the parties provided by GTC, as well as all the legal effects produced by GTC will be interpreted and governed in accordance with the Romanian legislation in force.
All disputes arising out of or in connection with the provision of services forming the subject matter of GTC will be settled by the competent Romanian courts at the headquarters of Aqua Geoterma Resource SRL.

Final provisions
The hotel has the right to unilaterally modify the GTC.
Modification of GTC will be opposed to customers from the date they were brought to their attention by any means (display, email, etc.).
Modification of GTC will not affect the charges for reservations already confirmed.
